The Faculty of History of Theory and History of State and Law



  The Faculty of Theory and History of State and Law was organized in September, 1972 and was designed to provide teaching of general theoretical and historical courses, which are essential at the Faculty of Law.
  P.N.Sergeiko, senior lecturer, was elected the Head of the Faculty at that time. The following members of the staff were employed at the Faculty: A.G.Talyupa, A.A.Sentsov, M.Kh.Khutyz (senior lecturers), P.G.Surinovich (lecturer), V.P.Belousova and L.A.Osipova (instructors).
  Later on O.A.Kovtun, V.V.Momotov, S.A.Danielyan, O.P.Oleinikova (senior lecturers), K.M.Martynenko and M.N.Tarasenko (professors), T.V.Lomakina and O.I.Shatokhina (lecturers), S.A.Zhinkin, O.I.Zhbyr, I.S.Bednaya (instructors) joined them.
  In September, 1974 A.G.Talyupa, senior lecturer, was elected the Head of the Faculty. Under his supervision the Faculty grew, successfully developed and realized its main tasks.
  From 1986 to 1995 Prof. M.Kh.Khutyz headed the Faculty.
  From 1995 to 1997 Prof. P.N.Sergeiko succeeded him.
  At present V.V.Momotov, senior lecturer, is the Head of the Faculty.
  The Faculty of Theory and History of State and Law provides the students with the following academic subjects:
  -Theory of State and Law;
  - Philosophy of Law;
  - History of National State and Law;
  - History of Foreign States and Law;
  - History of Political and Legal Theories;
  - Political Science;
  - Sociology of Law;
  - History;
  - Roman Law;
  -Theory of State Administration.
  The Faculty offers some new special courses in Comparative Law, Juridical Ethnography, Legislative Technique
  Scientific interests of members of the Faculty are embodied in the perspective scientific theme of their research: "Political and Legal Systems: Tendencies of Development". The following problems are touched upon in their research:
  1) Problems of Establishment of a Legal State;
  2) Evolution of Human Rights;
  3) Cross-national Relations and their Reflection in Political Legal System;
  4) Political Legal Aspects of Public Movements;
  5) Trends to Unification and Differentiation in Organizing and Functioning Political and Legal Systems;
  6) Development of Russian Medieval Law.

  In 1999 the Faculty took part in the contest, held by the "Open Society" Institute. The title of our project is "Property Law in Russian and Western Traditions: History and Modern Times".
  The objective of the research is to comparison the evolution of major legal and social institute - Property Law in Russian culture, more oriented at collectivism and ethatism, with Western and, mainly, European and Northern American (USA, Canada) cultures, based on individualism and liberalism, especially from the time of Protestant Reformation, the Age of Enlightenment and Great Social revolutions of the XVII-XVIII centuries.
  Elucidation of nature of property relations in Russian and Western cultures, historical regularities and peculiarities of different forms of the property, as well as features of forming a conception of property in Russian and Western public consciousness and public legal mentality is the key to understanding the nature of power in Russian and Western societies, as a necessary condition for understanding social and political destinies of a state and its people for many centuries.
  The strategy of the Faculty within the framework of the offered project is the following: utilizing specialization and the staff of the Faculty, especially post-doctorate and post-graduate students, young instructors and students, and, with the assistance of the Resources Centre of The Faculty of History of State and Law (Faculty of Law) of Moscow State University, named after M.V.Lomonosov, to name as priorities: theoretical and historical legal distinctions, evolution of appropriate political legal conception in Russia and in the West, and also philosophical, sociological, culturological, politological aspects of Property Law in Russian and Western traditions.
  The joint work at the above-mentioned theme will make it possible to improve the quality of teaching of such major lecture-courses as: Theory of State and Law, History of State and Law, History of Political and Legal Schools, Sociology of Law and Political Science and as a result the qualification of the staff of the Faculty is going to improve.
  The basic model of cooperation lies in long-term training courses for young instructors in the resources centre, joint seminars and, finally, in publication of the collective monograph.
  The Krasnodar Service of Migrationauthorized by Kuban Local authorities will also take part in work at the project.
  Students, post-graduates, young instructors, senior lecturers and professors participate in the working group of the Faculty. The role of the Resources Centre is, on the one hand, in supervising the Faculty and, on the other hand, in joint work at the complex problem of the research, which contributes to strengthening of scientific relations, both on individual and inter-university levels.
  The working group of the project, including not only the instructors, but also students and post-graduates of the Faculty was approved of by the Rector of the University.
